New H-1B Rules: EAD Extensions End as Visa Reviews Face Scrutiny

The US finalises an end to automatic work permit extensions while proposing stricter reviews for H-1B extensions. See who could be affected.

USCIS Reviews Work Permit Renewals and H-1B Petitions
Explore the end of automatic EAD extensions for certain applicants and the separate proposal to review H-1B extension petitions more closely.

H-1B Visa Extensions Face Fresh Scrutiny

The US Department of Homeland Security (DHS) has finalised a rule ending automatic extensions of certain Employment Authorization Documents (EADs). The policy affects eligible H-4 spouses, adjustment-of-status applicants and certain asylum seekers. Separately, the administration has proposed removing the deference policy for previously approved H-1B petitions, potentially subjecting extension requests to closer scrutiny.

What Are the New H-1B Visa Extension Rules?

The final EAD rule adopts the policy introduced on October 30, 2025. It takes effect upon publication in the Federal Register; the public comment period took place in 2025.

Under the rule, eligible EAD renewal applications filed on or after October 30, 2025, generally no longer receive automatic extensions while USCIS processes them.

Key changes include:

  • No automatic EAD extension: Filing an eligible renewal application generally no longer extends work authorisation automatically.
  • Affected applicants: The policy covers certain H-4 spouses, adjustment-of-status applicants and asylum seekers.
  • Limited exceptions: Specific statutory or regulatory exceptions may apply, depending on the applicant’s category and circumstances.

Separately, DHS has proposed rescinding the H-1B deference policy. This proposal is distinct from the final EAD rule and is not yet a final change.

How Will the New H-1B Rule Affect H-4 Visa Holders?

Some H-4 spouses of H-1B workers rely on EADs to work in the US. If an affected applicant’s current work permit expires before USCIS approves the renewal, they may face a gap in employment authorisation.

Applicants should check:

  • EAD category: Confirm whether the application falls under the affected rules.
  • Filing date: Applications filed on or after October 30, 2025, are generally covered.
  • Work permit expiry: Check whether the current EAD could expire before the renewal is approved.
  • Exceptions: Confirm whether any exception applies before making employment decisions.

Can H-1B Visa Extensions Face Additional USCIS Review?

Under the separate proposed rule, USCIS could reassess H-1B extension petitions without relying on the previous approval as a basis for deference. If finalised, this could mean:

  • Fresh eligibility review: Officers could examine extension requests more independently, even when the underlying circumstances appear unchanged.
  • More supporting evidence: Employers may need to demonstrate continued eligibility in greater detail.
  • Potential processing challenges: Additional scrutiny could lead to requests for evidence or other delays in individual cases.

The proposal does not itself change the H-1B visa grace period, which is governed by separate rules.

What Does This Mean for Green Card Applicants?

Neither development directly changes eligibility for US permanent residency or a United States Green Card. However, work authorization gaps and closer H-1B petition reviews could affect some workers’ employment and immigration planning.

Applicants should keep the following in mind:

  • H1B vs green card: These are different pathways, with different eligibility and filing requirements.
  • Green Card processing time: Monitor official updates for the relevant employment-based or family-based category.
  • EB-1A pathway: Those exploring this option can seek advice from an EB-1A best immigration consultant, but these developments do not change EB-1A eligibility criteria.

The immediate change is the end of automatic EAD extensions for affected applicants, while stricter review of H-1B extensions remains a separate proposal. Workers and employers should monitor official DHS and USCIS announcements for further updates.
