US EB-5 Visa Fees to More Than Double From November 30

EB-5 Visa Fees Are Set To Rise Sharply
The US Citizenship and Immigration Services (USCIS) has finalized a new EB-5 visa fee rule that will significantly increase filing costs for immigrant investors seeking US permanent residency through the EB-5 program. The changes take effect on November 30, 2026.
The EB-5 program allows qualifying foreign investors and their eligible family members to pursue a United States Green Card through investment in a qualifying US commercial enterprise and the creation of at least 10 full-time jobs.
How Much Will EB-5 Visa Fees Increase?
Under the new fee structure:
- Form I-526: $3,675 → $7,615
- Form I-526E: $3,675 → $7,850
- Form I-829: $3,750 → $5,000
The I-526 and initial I-526E fees include a new $75 technology fee. Regional-centre investors must also pay the separate EB-5 Integrity Fund fee.
When Will the New EB-5 Fees Take Effect?
The new fees will apply from November 30, 2026. Applications, petitions and requests postmarked on or after that date must include the new fees established under the final rule.
The rule also increases fees associated with regional centres, including the Form I-956 designation fee, which will rise to $44,115 from $17,795.
Who Will Be Affected by the EB-5 Fee Increase?
The changes will affect:
- Standalone EB-5 investors filing Form I-526
- Regional-centre investors filing Form I-526E
- Investors filing Form I-829 to remove conditions on permanent residence
- Regional centres and entities involved in EB-5 projects
The higher government filing costs are separate from the required EB-5 investment itself and other expenses such as legal and project-related costs.
For investors considering EB-5 as a route to a United States Green Card, the new fee schedule will add substantially to the overall cost of the immigration process. The rule does not itself change the underlying investment amounts required under the EB-5 program.
